Terms of Service

1. Acceptance of Terms

By creating an account or using GigTrain ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

GigTrain is a comedy professional suite offering gig management, setlist building, financial tracking, promotional image generation, gig application tools, promoter management, and digital business card features. The Service is offered in multiple subscription tiers (Bronze, Silver, Gold) with varying feature access.

3. User Accounts

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• Accounts default to the Bronze tier and locked state upon registration.
• You may delete your account at any time from the Profile page.

4. Subscriptions and Payments

• Subscriptions are billed via Base44 Payments (Wix) on a recurring basis.
• You can subscribe as a performer, promoter, or both, each with its own pricing.
• Upgrading or switching tiers cancels your existing subscription before creating a new one to prevent double-charging.
• Historical data (gigs, invoices) is retained independently of tier changes.
• Refunds are subject to the payment processor's refund policy.

5. User Conduct

You agree not to:

• Post false, misleading, or fraudulent gig listings or applications.
• Harass, blacklist unfairly, or defame other users.
• Upload copyrighted or inappropriate content without permission.
• Attempt to bypass subscription tier restrictions or access controls.
• Use the Service for any illegal or unauthorized purpose.

6. Promoter and Performer Relationships

GigTrain facilitates connections between performers and promoters but is not a party to any agreement made between them. We are not liable for gig outcomes, payment disputes, or performer performance. Promoters may blacklist performers at their discretion.

7. Intellectual Property

You retain ownership of your content (jokes, setlists, promotional images, business card details). By uploading content, you grant GigTrain a licence to display and process it within the Service. Promotional images generated via AI are provided for your use and may be subject to additional terms.

8. Limitation of Liability

GigTrain is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost income from missed gigs or payment disputes.

9. Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or engage in abuse of the platform.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
